Jinggoy ‘confused,’ to appeal bribery conviction in PDAF scam

(CNN PHILIPPINES) Metro Manila (CNN Philippines, January 19) — Senator Jinggoy Estrada on Friday expressed confusion over his bribery conviction in the pork barrel scam case, but said he is determined to challenge the verdict, even all the way to the Supreme Court.

While the Sandiganbayan ruled he was innocent of plunder, Estrada was found guilty of one count of direct bribery and two counts of indirect bribery.

“It is a must for me to appeal the conviction of bribery, and I have already asked my lawyers to exhaust all the legal remedies that are available for me,” he told CNN Philippines’ News Night.

“If ever the Sandiganbayan denies my motion, then I will go up to the Supreme Court,” the senator added.

In an earlier interview with CNN Philippines’ The Source, Estrada said he was surprised by the “sudden” decision, as what was included in the information sheet provided by the court was that the charge against him was “only plunder.”

“Now that I have been exonerated by the court, I’m a bit worried, not worried, but I’m confused why all of a sudden this bribery case came up,” he said, although he admitted he has not yet read the ruling.

In its nearly 400-page ruling, the Sandiganbayan explained that in the absence of sufficient evidence for plunder, a respondent could be convicted for a lesser offense.

The court cited the variance doctrine, “which allows the conviction of an accused for a crime proved that is different from but necessarily included in the crime charged.”

Based on the decision, Estrada may face jail time of up to 15 years for the three bribery cases.

The verdict also demands that he settle a fine of ₱3 million.

Asked about his possible expulsion from the Senate due to the conviction, he said he is placing his trust in his colleagues.

“All I can say is I will leave my faith to my colleagues in the Senate,” Estrada said.
