(ABANTE) Binigyang diin ni Senadora Imee Marcos at Senador Jinggoy Estrada na batay sa Konstitusyon, ang Kongreso lang ang nagtatakda ng petsa para sa Barangay at Sangguniang Kabataan Elections (BSKE).
Ginawa ng dalawang senador ang pahayag matapos maghain si Atty. Romulo Macalintal ng petisyon sa Korte Suprema na humahamon sa kalalagda lang na batas para sa sa pagpapaliban ng BSKE na nakatakda sana ngayong Disyembre 2022 subalit inilipat na sa Oktubre 2023.
“Not knowing anything about the case and working merely on general knowledge, it is the Constitution that vests in Congress the power to determine the terms of barangay officials,” sabi ni Marcos, chairperson ng Senate Electoral Reforms and People’s Participation.
“Necessarily, it is Congress which can determine when barangay and SK elections shall be held,” dagdag pa niya sa kaniyang ipinadalang mensahe sa mga reporter.
Ganito rin ang pahayag ni Estrada, isa sa mga author ng inaprubahan batas sa pagpapaliban ng barangay eleksyon.
“Congress is vested by the Constitution with legislative power and we exercised such authority when we moved to defer the holding of the poll exercise this year,” ayon kay Estrada.
“Such authority to postpone the barangay elections as well as the Sangguniang Kabataan elections has in fact been exercised thrice in the past prior to the enactment of RA 11935,” sambit pa niya.
“In a democratic society, everyone has an equal say on any issue, especially on the application of the law. Ang pagsampa ng petisyon sa Korte Suprema ay patunay na nanaig ang demokrasya sa ating bansa. Umaasa ako na papanigan ng kataas-taasang hukuman ang ipinasa naming batas,” saad ni Estrada.
Sabi naman ni Senador Francis Escudero, dating pinaburan ng Korte Suprema ang kahalintulad din na petisyon tungkol sa constitutionality sa pagpapaliban ng barangay eleksyon.
“Don’t want to comment as I haven’t read it. But suffice it to say that the SC has had occasion to rule on a similar issue [regarding the] constitutionality of a law on [Barangay and SK] postponement and ruled in favor of its constitutionality,” saad ni Escudero. -Dindo Matining/ Abante
